The Office of Compliance Fact Sheet Series

Updated March 1998 - Doc. No. 1150

Why Do I Have an NPDES Storm Water Permit?

The National Pollutant Discharge Elimination System (NPDES) was established to control the discharge of storm water and/or industrial discharges that could potentially affect the quality of waters of the United States . Storm water permits can be required for different types of activities, depending upon what Standard Industrial Classification (SIC) Code is associated with the activity. The Renewal Process IF you have an existing permit: You must fill out a NEW permit application Submit the application no less than 180 days PRIOR to expiration of your current permit. IF you miss the application deadline: The EPA Administrator for your region must approve a late submission. The date of submission cannot be after your current permit expires. IF you don't receive your new permit before your existing permit expires: Your existing permit will remain in effect until your new permit is received as long as you submitted your application prior to the deadline or you received approval for a late submission.
